End User (Client) Terms

When you set up an account to access and use our Services, we grant you an End User Licence to access and use these services. The terms of this End User Licence are as follows.
1. About PCVdigital
PCVdigital Limited (“PCVdigital”) is a UK registered company. We operate the PCVdigital platform as a service for our Business Customers who need to conduct appropriate identity and other verification checks for Anti-Money Laundering (AML) and Know Your Customer (KYC) requirements so that they can understand risk associated with a transaction. When our Business Customer invites you, their Client, to complete identity and other verification checks, they are inviting you to set up an account on our platform so that you can provide that information to us, on behalf of our Business Customer.
2. Our services
We use the information you provide us to carry out identity and other checks using third-party services. All this information is then available to the Business Customer who requested the checks, but not to anybody else. Your information is held securely by us.
3. How do you use our Services?
After you receive an invitation from your advisor (who is our Business Customer) to provide information, you follow the email link to register an account with us, then you provide the information we need for the verification checks. Your advisor (our Business Customer) can access this information. If the Business Customer needs more information, they will contact you to ask you to provide that via your account with us.
You should ensure the personal data you provide to us is accurate, complete and provided in a form that we can process. If you don’t have all the information to hand, you can return to our site, log-in to your account and provide that information later.
4. Licence to use our services
We give you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the software provided to you as part of the Services. This license has the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by us in the manner permitted by these Terms. When you create an account, you are agreeing to this Licence to use our Services in accordance with these Terms.
Nothing in these Terms gives you a right to use the PCVdigital name or any of our trademarks, logos, domain names, other distinctive brand features, and other proprietary rights. All right, title, and interest in and to the Services (excluding Content provided by users) are the exclusive property of PCVdigital.
Your obligations under this Licence
- You agree that you:
- Will allow the data you provide us to be shared with our Business Customer
- Will only use the services to supply the information requested, and only for your own benefit
- Will not use the services for any unlawful act
- Will not send spam or other unwanted communications to us
- Upload content with viruses or other harmful code, or which you don't have the rights to use,
- Will not reverse engineer or otherwise try to derive any of our source code or related technology
- Will not scrape, crawl or spider our services or website, nor interfere in any way with their operation, nor act in any way to cause damage to them
- Will not use any of our brands, trademarks or logos without our permission
5. Licence Suspension
We have the right to suspend your Licence and your access to the Services without notice, if we suspect that you are in breach of these terms of use.

7. Anti-virus software
Whilst we endeavour to ensure our services are virus-free, it is your responsibility to make sure your devices are protected against viruses and malicious software.
8. Service availability
We endeavour to make our service available at all times, but on occasions you may not be able to access or use our services due to events outside our control, including technical issues or security threats. If our service is unavailable for any reason, we are not responsible to you in any way for any consequences that such lack of availability may cause.

10. Result of the verification checks
We do not recommend how our Business Customer judges risk as a result of the validation services that we provide. We accept no responsibility for the outcome of any such decision by our Business Customer.
11. Changes to these terms
We may revise these Terms from time to time. The changes will not be retroactive, and the most current version of the Terms, which will always be available on our website, will govern our relationship with you. We will try to notify you of material revisions, for example via a service notification or an email to the email associated with your account. By continuing to access or use the Services after those revisions become effective, you agree to be bound by the revised Terms.
12. Disclaimers and limitations of Liability
The Services are available to you on an ‘as is’ basis and ‘as available’. Your access to and use of the Services are at your own risk. Without limiting the foregoing, to the maximum extent permitted under applicable law, PCVdigital disclaims all warranties and conditions, whether express or implied, of merchantability, fitness for a particular purpose, or non-infringement. We make no warranty or representation and disclaim all responsibility and liability for: (i) the completeness, accuracy, availability, timeliness, security or reliability of the Services; (ii) any harm to your computer system, loss of data, or other harm that results from your access to or use of the Services; (iii) the deletion of, or the failure to store or to transmit, any content maintained by the Services; and (iv) whether the Services will be available on an uninterrupted, secure, or error-free basis. No advice or information, whether oral or written, obtained from the us or through the Services, will create any warranty or representation not expressly made herein.
Our Limitation of Liability
To the maximum extent permitted by applicable law, PCVdigital shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services, including without limitation, any defamatory, offensive or illegal conduct of other users or third parties; (iii) any content obtained from the services; or (iv) unauthorized access, use or alteration of your transmissions or content. In no event shall the aggregate liability of PCVdigital exceed £100.
11. Governing law and jurisdiction
This Licence is governed by the laws of England and Wales and the courts of England and Wales have exclusive jurisdiction to settle any disputes in relation to it.
